Terms of Use



1 § These Terms of Use regard all use of the Website and the material contained therein. The User must agree to these Terms in order to download software from the Website. By doing this, the User accepts the Terms and agrees to be bound by them, even if no acceptance is explicitly expressed.

2 § "The Author" shall here be understood as the author of the software on the Website, Thomas Sundell.

"User" refers to a person who downloads the software from the Website or receives a copy of the software from another User.

"The Website" refers to the web pages at <http://www.sunpoint.net/~tsundell/> and their content. Should the URL change at a later stage, these terms of use apply to the new Website, regardless of the fact that this actual version of the terms are outdated, if no newer version is available or the User for some reason has not been able to obtain the most recent version.

3 § All software and photography artwork on the Website is copyright protected. All copying, selling, hiring, lending, exhibition, decompiling, reverse assembling, modification, and creating derivative works thereof is prohibited unless otherwise stated, or written authorisation from the Author is obtained. Any such activity is a copyright infringement and may become subject to legal measures, including but not limited to prosecution and claims for compensation.

4 § The User may download the software from the Website for his or her own personal use. If the User intends to use the software for any other purpose, the Author should first be consulted.

The Author's REALbasic® modules may be included as part of the User's own software project, as long as the Author is mentioned in the credits, the modules are not modified in any way, and the modules are not the most essential part of the User's software.

5 § The Author assumes no liability for any direct or consequential damage caused by the installation or use of software offered on the Website. The User is to read all relevant documentation in order to prevent any such damage. The Author does not make any guarantees as to the suitability of the software for any particular purpose the User might have.

6 § Being part of the copyright, the means of distribution remains at the Author's discretion, and exceptions can be made provided that the Author is consulted before any such action.

The freeware nature of the software on the Website contains certain limitations:

1) distribution is permitted from hand to hand provided that all documentation is enclosed, but the software must not without the Author's consent be uploaded to any server, BBS, or similar, for distribution purposes;
2) any links to the software as located on the Website must be made to the parent page or the main page, not directly to the program file;
3) the software must be distributed free of charge (however, the User may charge for the cost of the storage media, for example a CD-R disc); and
4) the software must not without the Author's consent be given away in the interests of the public relations of a company or similar, because this is a way of indirectly profiting from the software.

7 § The copyright is governed by the provisions of the Copyright Act of Finland and international copyright treaties. Finnish law shall be applied to any disputes arising from the software, the use of the software, the Website, or these terms of use. The dispute shall be settled in a Finnish court, whenever possible at the Author's domicile.
